CONSUMER RIGHTS - WITHDRAWAL - CANCELLATION AND RETURN CONDITIONS

GENERAL:

1. When you place an order in an electronic environment through the website you are using, you are considered to have accepted the preliminary information form and the distance sales contract provided to you.

2. Buyers are subject to the provisions of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188) and other relevant laws in force regarding the sale and delivery of the product they purchased.

3. If the shipping costs for the product are below the specified limits, they will be borne by the buyer.

4. Each purchased product will be delivered to the person and/or organization indicated by the buyer at the specified address within 30 days, provided that this period does not exceed the legal period. If the product is not delivered within this period, the buyer may terminate the contract.

5. The purchased product must be delivered complete and in accordance with the specifications specified in the order.

6. If it becomes impossible to sell the purchased product, the seller must notify the buyer in writing within 3 days from the date they become aware of this situation. The total price must be refunded to the buyer within 14 days.

NON-PAYMENT OF THE PURCHASED PRODUCT:

1. If the buyer does not pay the purchase price or cancels the payment in the bank records, the seller's obligation to deliver the product is terminated.

PURCHASES MADE WITH UNAUTHORIZED USE OF CREDIT CARDS:

1. After the product is delivered, if it is determined that the buyer's payment card has been used improperly by unauthorized individuals and the selling price of the product is not paid to the seller by the relevant bank or financial institution, the buyer must return the product to the seller within 3 days, with the shipping cost borne by the seller.

NON-DELIVERY OF THE PRODUCT DUE TO UNFORESEEN REASONS:

1. If unforeseen force majeure events occur, and the product cannot be delivered on time, the situation will be communicated to the buyer. The buyer can request the cancellation of the order, replacement of the product with a similar one, or postponement of the delivery until the obstacle is removed. If the buyer cancels the order and has paid in cash, the amount will be reimbursed within 14 days from the date of cancellation. If the payment was made by credit card and the order is canceled, the product price will be refunded to the bank within 14 days, but it may take 2-3 weeks for the bank to transfer it to the buyer's account.

BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

1. Before accepting the goods or services subject to the contract, the buyer will inspect them; they will not accept damaged or defective goods or services, such as dents, breakage, torn packaging, from the cargo company. The delivered goods/services will be deemed to be undamaged and sound. The BUYER must take care to protect the product after delivery. If the right of withdrawal will be used, the product/service must not be used. The invoice must be returned with the product.

RIGHT OF WITHDRAWAL:

1. The BUYER, within 14 (fourteen) days from the date of delivery of the product purchased to itself or the person/organization at the address specified, without assuming any legal or criminal liability, and without showing any reason, by notifying the SELLER through the contact information below, may exercise the right of withdrawal from the contract.

DURATION OF THE RIGHT OF WITHDRAWAL:

1. If what the buyer has purchased is a service, the 14-day period begins from the date the contract is signed. The right of withdrawal cannot be used in service contracts where the service has started with the consent of the consumer before the end of the withdrawal period. 

2. The expenses arising from the use of the right of withdrawal shall be borne by the SELLER.

3. To use the right of withdrawal, written notification must be sent to the SELLER by registered mail, fax, or email within the 14-day period and the product must not be used within the scope of the provisions regarding "Products for Which the Right of Withdrawal Cannot Be Used" regulated in this contract.

USE OF THE RIGHT OF WITHDRAWAL:

1. If the product is delivered to a third party or the BUYER at the address indicated by the BUYER, the invoice of the product to be returned must also be returned with the product. (For the returns of orders issued on behalf of companies, the refund invoice issued by the company must be sent together with the product. Order returns issued on behalf of companies will not be completed unless the RETURN INVOICE is issued.) 

2. The box, packaging, if any, standard accessories of the product to be returned must be complete and undamaged.

RETURN CONDITIONS:

1. The SELLER is obliged to refund the total price and all the documents that put the BUYER under debt within a maximum of 10 days from the date the withdrawal notification reaches him. 

2. If there is a decrease in the value of the goods due to a reason arising from the fault of the BUYER or if it becomes impossible to return, the BUYER is obliged to compensate the damages of the SELLER in direct proportion to his fault. However, the BUYER is not responsible for any changes and impairments caused by the proper use of the product within the withdrawal period. 

3. If the campaign limit amount set by the SELLER is exceeded due to the use of the right of withdrawal, the amount of the discount used within the scope of the campaign will be canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED:

1. The return of products that are prepared according to the BUYER's request or that are not suitable to be returned due to their nature, that cannot be separated after delivery, that are mixed with other products after delivery, and that are not suitable for health and hygiene reasons when their packaging is opened by the BUYER, is not possible according to the Regulation. 

2. Also, it is not possible to use the right of withdrawal for services that have started to be performed with the consent of the consumer before the end of the right of withdrawal period according to the Regulation.

DEFAULT AND LEGAL CONSEQUENCES:

1. If the BUYER defaults on payment by credit card, the BUYER acknowledges, declares, and undertakes that he will pay interest within the framework of the credit card agreement with the bank and be liable to the bank. In this case, the relevant bank may apply to legal remedies; claim the costs that may arise and the attorney's fee from the BUYER, and in any case, the BUYER agrees that he will pay the damages and losses incurred by the SELLER due to the delayed performance of the debt.
